Donald H. Smith is counsel in Sidley Austin’s Washington, D.C. office. He primarily represents transportation companies, including railroads, motor carriers, and private truck fleets, in a variety of regulatory proceedings and related appeals. He represents railroads and the Association of American Railroads in a wide range of administrative and appellate litigation, including rail mergers and acquisitions, ratemaking, and industry-wide rulemaking proceedings before the Surface Transportation Board. He also represents railroads in appellate and commercial litigation.
Donald also represents motor carriers in regulatory proceedings before the U.S. Department of Transportation’s Federal Motor Carrier Safety Administration, and advises motor carriers and their affiliates regarding FMCSA licensing, registration, and regulatory compliance. He also advises companies seeking to operate unmanned aerial vehicles and systems (drones) for commercial purposes under the Federal Aviation Administration’s Part 107 and Section 333 regulations.
