Kevin Dam is a director at KISCH IP and he is the Head of their Commercial Department. Kevin has extensive experience in the negotiation, preparation and drafting of licensing, technology transfer agreements such as sale or licensing of technology, the structuring of such transactions and the regulatory controls involved. He assists clients with the negotiation, structuring and drafting of licence agreements, including and together with advising and transaction structuring, offshore tax structuring and exchange control approval.
He assists clients with the structuring of their IP portfolios and the offshore structuring of IP transactions. He deals with all aspects of mediation, arbitration and Court litigation, particularly in the areas of commercial and corporate litigation. He deals with commercial disputes concerning shareholder disputes, corporate governance, company acquisitions and take-overs, commercial fraud, restraint of trade disputes, enforcement of commercial contracts. Kevin has represented his clients in various High Courts in South Africa; the US Federate Court and various local and foreign arbitration forums. He advises local and international clients on South African competition law and its effect on business transactions, mergers, acquisitions, joint ventures, licensing arrangements and distribution practices.
