Dr. Kim Manuel Künstner is a member of SCHULTE RIESENKAMPFF.’s antitrust law department, which advises national and international corporations on German and European antitrust law and merger control matters. Kim Manuel advises companies in cartel fine proceedings conducted by the German Federal Cartel Office (Bundeskartellamt) and the European Commission. In this regard he also represents his clients before the European General Court and the European Court of Justice, e. g. in the cases window fittings and candle waxes.
With regards to merger control matters, Kim Manuel Künstner advises on German, European and global transactions before the German Federal Cartel Office as well as before the European Commission. For example Kim Manuel lately advised on the concentration of two global leaders in the field equipment manufacturing. The complex merger control process involved several major jurisdictions across the globe and was cleared unconditionally by the German Federal Cartel Office in Phase II after 12 months.
Moreover, Kim Manuel Künstner provides legal advices on all relevant questions regarding an antitrust law compliant design of contracts and agreements. This includes the establishment and/or dissolution of a cooperation between competing companies (Joint Ventures, consortia, etc) as well as distribution agreements (rebate systems (for dominant undertakings), supply claims, R&D agreements, etc)
Furthermore, Kim Manuel represents companies in cartel damages proceedings before the courts and provides compliance trainings for the client's managers and employees.
