Kai Birke is a partner in the Gleiss Lutz finance and capital markets group and heads the firm’s debt capital markets practice. He advises corporate clients and financial institutions on debt capital markets and syndicated lending transactions. He has broad expertise in advising corporate clients on the restructuring of their financial indebtedness, in particular on bond restructurings.
His recent work includes advising the following clients:
Pfleiderer group on its refinancing by the issuance of a high-yield bond governed by German law;
Credit Suisse and Jefferies in connection with a secured high-yield bond issued by Löwen Play;
Various underwriters in relation to high-yield bond offerings by Fresenius Medical Care, Fresenius SE and NXP Semiconductors;
WindMW on the refinancing of the offshore wind park Meerwind through the issue of green bonds (US and European private placement, German registered notes and promissory notes).
Bond restructuring credentials include advising the bondholder ad hoc committee consisting of various hedge funds in connection with the financial restructuring of IVG AG (Global Finance Deal of the Year - Restructuring - American Lawyer).
